The lawyers are named in alphabetical order. The information on fields of specialization and correspondence languages were obtained from the lawyers themselves and cannot be guaranteed by the embassy. The list does not claim to be complete.
Jurisdiction and compulsory lawyer
There are no regulations regarding local jurisdiction in Malta. Maltese law differentiates between legal procurators and lawyers/advocates. While legal advisors are only admitted before the “Magistrate Court”, lawyers are admitted to all Maltese courts.
In principle, in accordance with Article 204 (1) (a) of the Code of Organization and Civil Procedure (hereinafter referred to as “CodeOrg”), there is no legal requirement to have a lawyer. In special cases, however, this can be ordered by law. In addition, according to Art. 205 Para. 2 CodeOrg, the court can stipulate that the party not represented by a lawyer must appoint a lawyer if they are not able to bring their case forward appropriately.
Legal aid and public defender
Legal aid is granted within the framework of certain income and financial circumstances on the basis of Art. 911 ff. CodeOrg.
A corresponding application should be made to the Civil Court, First Hall in accordance with Article 911 Paragraph 1 CodeOrg, but it is also possible orally to the Advocate for Legal Aid. According to Art. 912 CodeOrg, the applicant has to swear that he
- has legitimate reasons for prosecution and
- has no assets of € 6,988.12 or more (excluding everyday necessities and main residence) and his annual income does not exceed the national minimum wage for an eighteen-year-old person.
The correction or deletion of entries in public registers as well as the registration of births, marriages and deaths, Art. 913 para. 1 CodeOrg, are excluded from legal aid.
The Advocate of Legal Aid checks in accordance with Article 914 Paragraph 1 of the CodeOrg whether the prosecution appears justified and reports on this to the Civil Court, First Hall. This examination is not necessary if the defendant is the applicant.
If the outcome is positive, the Civil Court, First Hall, will designate the lawyer to be assigned to the applicant. This is selected from the legal profession according to a certain rotation procedure according to Art. 91 ff. CodeOrg. The applicant can only reject the assigned attorney for a legitimate reason in accordance with Art. 918 Paragraph 1 CodeOrg.
The granting of legal aid means that the applicant does not have to pay any fees or provide securities. Security is to be provided only in the case of a counterclaim, Art. 920 Para. 1 CodeOrg
Court and legal fees
The applicable fees are regulated by Art. 1004 ff. CodeOrg. In Malta, this includes both court and legal fees. The amount of the fees is determined by the amount in dispute.
The lawyer's fees are regulated by Tariff E of Schedule A for CodeOrg. According to Art. 82 CodeOrg, a lawyer may in principle only raise fees in the amount prescribed by law.
